Substance Abuse Policy

TO: All Staff/Personnel

FROM: Management

Substance/Alcohol abuse is prohibited in this Office. Effective immediately, in order to provide a safe work and productive work
environment, as a condition of continued employment with this Company, anyone who comes to work and exhibits questionable
behavior/attitude/demeanor and/or poor work performance while working in this Office and is suspected of being under the influence of a control substance such as drugs and/or alcohol, will be asked to submit to a drug/alcohol test.

If confronted/questioned by Management, you will be given the opportunity to explain your questionable behavior/attitude/demeanor and/or poor work performance working before taking the drug/alcohol
test, such as you are taking a doctor prescribed medication, proof of said current/valid prescription to be provided, or you have a
current/valid medical marijuana card to be provided as proof. A drug/alcohol test will still be administered/performed to document the event/incident. If it is determined/suspected that you are abusing your prescription(s)/medical marijuana you will be asked to seek counseling/treatment for your condition. Proof of counseling/treatment for your condition will be required to be on file
with this office. Said information shall be confidential and not to be shared with staff or anyone outside of this office, unless you have signed a written release of said information, or it is required to be released by law. This will constitute a first warning.

If confronted/questioned by Management, and your explanation is/ you admit you are under the influence of an illegal control substance or over the alcohol legal limit to operate a vehicle in Missouri, a test will not be administered. You will be required to sign an agreement that you will seek counseling/treatment for your illegal substance/alcohol use. Proof of counseling/treatment for your condition will be required to be on file with this office. Said information shall be confidential and not to be shared with staff or anyone outside of this office, unless you have signed a written release of said information, or it is required to be released by law. This will constitute a first warning.

If confronted/questioned by Management, and a tests is performed and if it is determined per the test results that at the time of test you are/were under the influence of an illegal control substance or over the alcohol legal limit to operate a vehicle in Missouri, you will be required to sign an agreement that you will seek counseling/treatment for your illegal substance/alcohol use. Proof of counseling/treatment for your condition will be required to be on file with this office. Said information shall be confidential and not to be shared with staff or anyone outside of this office, unless you have signed a written release of said information, or it is required to be released by law. This will constitute a first warning.


If confronted/questioned by Management a second time/incident for suspected questionable behavior/attitude/demeanor and/or poor work performance while working in this office, and a test will be performed, and if it is determined per the test results that at the time of the test you are/were under the influence of an illegal control substance or over the alcohol legal limit to operate a vehicle in Missouri, and this is your second incident for suspected illegal control substance use/over the legal alcohol limit, you will receive a written warning and will be suspended from work with no pay for one (1) week. You will be required to sign an agreement that you will seek counseling/treatment for your illegal substance/alcohol use. Proof of counseling/treatment for your condition will be required to be on file with this office. Said information shall be confidential and not to be shared with staff or anyone outside of this office, unless you have signed a written release of said information, or it is required to be released by law. This will constitute a second warning.

If confronted/questioned by Management a third time/incident for suspected questionable behavior/attitude/demeanor and/or poor work performance while working in this office, and a test will be performed, and it is determined per the test results that at the time of the test you are/were under the influence of an illegal control substance or over the alcohol legal limit to operate a vehicle in Missouri, and this is your third incident for suspected illegal control substance use/over the legal alcohol limit, you will receive a written warning and you will be suspended for work with no pay for one (1) week pending termination of your employment.
